Market participants may sell or purchase compliance instruments consisting of allowances, offset credits, and sector-based offset credits in the secondary market. Compliance instruments do not expire, which enables covered entities to 'bank' and hold compliance instruments until they are needed and other market participants to hold and sell compliance instruments without any deadlines for sale. Information for each trade, including trade date, settlement date, and price, is required to be reported to the accounts administrator of the program. The program also will prohibit any trading activity of compliance instruments that involves an undisclosed counterparty, manipulative or deceptive devices, fraud, reporting of false or misleading information, misrepresentations, or other efforts to falsify or conceal material facts from the market.
The Dodd-Frank Wall Street Reform and Consumer Protection Act establishes an interagency working group, headed by the Commodity Futures Trading Commission, to conduct a study on the oversight of existing and prospective carbon markets, including oversight of the spot markets and derivative markets. The interagency group is required to submit to Congress a report, no later than January 17, 2011, on the results of the study, including recommendations regarding such oversight. Potential market participants in the California cap and trade program should keep track of these developments.

In each instance, the analysis showed that the WCI program would support robust economic growth and deliver net cost savings-even when the assumptions resulted in different carbon allowance prices.

Greenhouse Gas Emissions Verification Info
Background
On December 6, 2007, pursuant to the California Global Warming Solutions Act of 2006, the Air Resources Board (ARB) approved the Mandatory Reporting of Greenhouse Gas Emissions regulation. The regulation requires the mandatory reporting and verification of greenhouse gas (GHG) emissions. Facilities subject to mandatory reporting are required to have their greenhouse gas emissions verified beginning in 2010, for their 2009 reported emissions. Facilities will be subject to either annual or triennial verification. Only the following ARB accredited verification bodies and verifiers may provide verification services for the purposes of mandatory greenhouse gas emissions reporting.
Revisions to the Regulation for Mandatory Reporting of GHG Emissions
The proposed revised regulation and staff report are available now, including supporting documentation. ARB staff is proposing revisions to the California GHG reporting regulation to support a greenhouse gas cap-and-trade program and to harmonize with the U.S. EPA greenhouse gas reporting requirements. The revisions will be considered by the Board on December 16, 2010. Details about the meeting and for submitting comments are available at the regulatory website for this item.

Verification Fact Sheet - Information for reporters about hiring a verifier, conflict of interest, and the verification process.
Finding a Verifier. A list of accredited verifiers is now available. Reporters must contract with an ARB-accredited verification body in 2010 for verification of their 2009 emissions reports. Remember that verifiers cannot act as consultants as you prepare your emissions report, but must provide an independent review after your report is certified and submitted. A Verification Fact Sheet is available to assist with the verification process.

Revisions would apply to 2012 greenhouse gas reporting.
Reporting Workshop - October 12, 2010. Depending on the specific industrial sector, 2011 emissions reports from facilities were due on either April 1, 2011 or June 1, 2011.
